5. Arbitration

5.1 Binding Arbitration

Except as otherwise provided herein, any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, or your use of the Site (collectively, "Disputes"), shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Commercial Arbitration Rules.

5.2 Arbitration Procedures

• The arbitration shall be conducted by a single arbitrator mutually agreed upon by the parties, or if the parties cannot agree, appointed by the AAA.
• The arbitration shall take place in Kalispell, Montana, or at a location mutually agreed upon by the parties.
• The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
• Each party shall bear its own costs and attorneys' fees, unless the arbitrator determines otherwise.

5.3 Exceptions to Arbitration

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to protect intellectual property rights or to prevent irreparable harm.

5.4 Class Action Waiver

You agree that any arbitration or proceeding shall be conducted on an individual basis and not as a class action, consolidated action, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

6. Court Jurisdiction (Fallback)

If for any reason a Dispute is not subject to arbitration, or if the arbitration provision is found to be unenforceable, you agree that any judicial proceeding shall be brought exclusively in the state or federal courts located in Flathead County, Montana, United States. You consent to the personal jurisdiction of these courts and waive any objection to venue in these courts.

7. Limitation of Liability

7.1 Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

AANIKA INFINITE DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. AANIKA INFINITE MAKES NO WARRANTIES REGARDING THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF THE CONTENT.

7.2 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AANIKA INFINITE LLC, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR REPRESENTATIVES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

7.3 Cap on Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AANIKA INFINITE'S TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00 USD).

7.4 Basis of the Bargain

You acknowledge that the limitations of liability set forth in this Section 7 are fundamental elements of the basis of the bargain between you and Aanika Infinite, and that Aanika Infinite would not provide the Site without such limitations.

8. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if such modification is not possible, such provision shall be severed from these Terms. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of any other provision, and the remaining provisions shall continue in full force and effect.

9.1 Ownership

9.2 Limited License

Subject to your compliance with these Terms, Aanika Infinite grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Site for personal, non-commercial, informational purposes only. This license does not include any right to:

14.3 Waiver

You may not assign or transfer these Terms or any rights or obligations hereunder without Aanika Infinite's prior written consent. Aanika Infinite may assign these Terms without restriction. Any attempted assignment in violation of this Section shall be void.

14.5 Force Majeure

Aanika Infinite shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
